In MS foreclosure law, the mortgage lender can also undertake the judicial process although the non-judicial procedure is more popular. A power of sale clause in the mortgage is required in a non-judicial foreclosure. Thus, the lender will have to go to court if at the start, no power of sale clause had been included in the mortgage agreement. The lender has to file a document known as a lis pendens and a complaint in court. In this process, the court will have to issue a final judgment of foreclosure and then the home will be sold in a public auction by the sheriff.
